Wholesale Terms & Conditions

Thank you for being part of the True community. 

The Terms and Conditions (“Terms”) provided below are in addition to the General Terms and Conditions found here.

Please read both documents carefully before submitting your Wholesaler application. 

These Terms are a binding legal agreement between you and True Protein that govern your right to use the website, products, content and other offerings from True Protein. The terms, “we”, “us” and “our” within these Terms refer to True Protein.  

By visiting our website and/or purchasing our products, apparel and accessories, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including any additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms are applicable to all users of your True Protein Wholesale Account (“Account”), this includes visiting our website and/or the purchase of products, use of provided content and other offerings from True Protein. 

By submitting an application to become a Wholesaler you and any users of your Account agree to be bound by these Terms and enter into a legally binding contract upon approval of your application. Please note, your acceptance of these Terms is not approval of your application. You will be notified via email of the outcome of your application within 5 business days of submission.   

Terms of Sale 

True Protein products, accessories and apparel obtained via the Wholesale Program must be distributed to customers at your physical business premises or via a face-to-face transaction.  

Wholesale pricing can be found within the wholesale website portal once your application is approved and are subject to change as outlined in our General Terms and Conditions. 

You must meet the minimum spend order value to receive the wholesale discount. Any orders below this value will be charged at the full recommended retail price. 

Online Sales 

No online sales are permitted. This includes ecommerce platforms of all types, marketplaces such as eBay and Amazon and sale through social platforms. Using online sales for ‘click and collect’ delivery is also a contravention of these Terms. 

Advertising & Ad Words 

No wholesaler is permitted to run competing digital advertisements across platforms such as Google, Microsoft or Social platforms. You agree not to purchase any Google Ads, domain names, social ads or bid on any keywords, search terms, or any other identifiers that include the word "True Protein" or the names of True Protein products and services, or any variations or misspellings thereof.  

Product Claims 

Please adhere to product claims and language used on our website, including the product pages.  

It is the responsibility of each business to understand and comply with the regulatory requirements of the products they list and that claims made comply with the relevant regulatory body guidelines, such as the Therapeutic Goods Administration (TGA) and Foods Standards Australia New Zealand (FSANZ). 

Marketing True Protein 

As an approved wholesaler you will have access to the Wholesale Marketing Assets Dropbox containing authorised images and content you can use to promote True Protein to your customers. Unless otherwise permitted directly by a True Protein team member, True Protein retain the content rights over all other content and use without permission is an infringement of our rights and those of our athletes and photographers. 

Social Platforms Use 

You can use the images and content provided in the above mentioned Dropbox to promote True Protein on your social platforms in adherence with the below: 

• You are not authorised to use any True Athlete imagery from our social media pages or their personal pages. 
• Only use the @True Protein tag when speaking directly about a True Protein product. 

• Please do not use the following hashtags #TrueAthlete #TheNaturalEdge #TrueProtein.  
• If you would like to use the hashtag #TrueProtein, please add Reseller or Wholesaler at the end, for example #TrueProteinWholesaler, #TrueProteinReseller. 

Promotions 

If you are approved as a wholesaler, you will have access to the promotions that form part of the Wholesale Program. Details of the promotions can be found within your wholesale portal and these are subject to change. Please note, you are not eligible for B2C promotions found on our general website. 

True Communications 

To stay up to date with our new products, promotions, incentives and any other updates or changes to the Wholesale Program, we recommend you stay subscribed to our marketing emails. If you choose to unsubscribe, you may miss out on communications that could benefit your business and customers. If you are not receiving our email communications, please contact our Customer Experience team on 1300 536 688 or contact@trueprotein.com.au. 

Disclaimer 

True Protein reserves the right to make changes to the program at any time. Wherever possible, we endeavor to provide advanced notice of any changes before they become effective.  

Acknowledgement 

As a True Wholesaler you agree to abide by these Terms and acknowledge any breaches of them result in removal from the program, with further action taken where necessary.
